Agreement to these terms

These Terms of Use cover your use of mikeshadybowling.com (the "site"). The site is run by Mike Shady ("Mike Shady Bowling," "we," "us"). By using the site or sending us a form, you agree to these terms. If you don't agree, please don't use the site.

If you register a youth bowler, or send a request for a bowling center, team or organization, you accept these terms for them as well as for yourself, and you confirm that you're allowed to do that.

The site is for bowlers of all ages and their families, but it isn't meant for children under 13 to use on their own. If you're under 18, please use the site with a parent or guardian's permission. If you're under 13, please don't send us a form yourself: ask a parent or guardian to fill out the form or contact Mike for you.

About the site and services

Mike Shady Bowling is a small coaching business run by Mike Shady, a USBC Hall of Famer and Team USA coach. The site tells you about:

  • Bowling camps and clinics for youth and adult bowlers
  • Online video lessons: you send your videos, meet Mike in a live Zoom session, and get your results through the OnForm coaching app
  • Onsite (in-person) lessons
  • Mental game training
  • Events hosted by bowling centers ("Host Mike"): camps, clinics, training sessions and speaking engagements

The site has no user accounts, no logins and no online store. To ask about pricing, email Mike at coachshady@gmail.com.

Using the site

Please use the site fairly and for what it's meant for. When you use it, you agree not to:

  • Send spam, junk or bulk messages through our forms
  • Harass, threaten or abuse Mike or anyone else
  • Try to break into, overload or get around the site's security, spam checks or rate limits
  • Use bots, scrapers or other automated tools to send forms or copy the site
  • Pretend to be someone else, or send a form for someone without their permission
  • Use the site for anything illegal

When you fill out a form, please give accurate, up-to-date information so Mike can reach you and plan for the right bowler. We may ignore or delete form entries that look like spam or abuse, and we may block anyone who misuses the site.

Camps, lessons and events

Camp dates, locations, sessions, formats and other details on the site may change, and a camp, lesson or event may be rescheduled or canceled. We try to keep the site up to date, but please check with Mike for the latest details.

A camp registration, Host Mike request or message sent through this site is a request, not a booking. Your camp spot or event is confirmed only when Mike confirms it with you by email. Lesson times booked on Mike's YouCanBookMe calendars follow the confirmation you get from YouCanBookMe.

Prices aren't listed on the site. Before you pay, ask Mike for the price and any deposit, cancellation or refund terms. Those terms apply to your camp, lesson or event along with these terms. For events hosted by a bowling center or organization, the details are worked out between the host and Mike before the event.

Bowlers under 18 must be registered by a parent or guardian, who accepts these terms for the bowler and is responsible for the information they send. Please use your own email address when you register a youth bowler.

Camps and lessons are physical activity. Participants should be in suitable health to take part, and should check with a doctor first if they're unsure. Each participant (or the parent or guardian of a youth bowler) decides whether they're fit to take part. Some camps may require a separate waiver or participation agreement; if a camp does, it must be signed before the bowler takes part.

Bookings and payments through other services

Some booking and payment steps happen on other companies' sites, not on this one:

  • YouCanBookMe: lessons are booked through Mike's YouCanBookMe calendars.
  • Venmo: mental game training can be paid through Mike's Venmo.
  • Zoom and OnForm: online lessons use Zoom for the live session and the OnForm app for your results.
  • Stripe or Square: if camp deposits are added later, you would pay on the payment provider's own page.

When you use those services, their own terms and privacy policies apply, and each company is responsible for its own service. This site never asks for, receives or stores your card or bank details. Any payment you make is covered by the price and any deposit, cancellation or refund terms Mike shares with you.

Disclaimers

Every bowler is different. Improvement depends on practice, effort, physical ability and many other things, so we can't promise any particular score, average or result from a camp, lesson or training session.

Tips and coaching information on the site are general information. They aren't personal instruction for your game, and they aren't medical advice.

The site is provided "as is" and "as available." We can't promise it will always be complete, current, error-free or online. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Limitation of liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.

Apart from that, and to the extent the law allows, Mike Shady Bowling and Mike Shady are not liable for any indirect, incidental, special or consequential damages, or for lost profits or lost data, that come from your use of the site.

Apart from that, and to the extent the law allows, our total liability for any other claim about the site or our services is limited to the greater of $100 or the amount you paid Mike Shady Bowling for the camp, lesson or event the claim is about. This limit doesn't apply to claims for bodily injury.

The risks of taking part in a camp or lesson are covered by any separate waiver or participation agreement for that camp or lesson. Nothing in these terms takes away any rights you have as a consumer under the law that applies to you.

Your responsibility for misuse

If you misuse the site or break these terms, and that leads to a claim against Mike Shady Bowling, you agree to be responsible for it, including reasonable costs, to the extent the law allows.

Governing law and disputes

These terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict of law rules.

If you have a problem, please email Mike first. Most issues can be sorted out with a conversation.

If a dispute can't be settled that way, it will be handled in the state or federal courts located in Wisconsin, and you and we agree to those courts' jurisdiction. Either of us may also bring a claim in small claims court if it qualifies. If you're a consumer living outside the US, you may also be able to bring a claim in the courts where you live, and the consumer protection laws of your country still apply to you.

If any part of these terms is found to be unenforceable, the rest still applies.

Changes to these terms

We may update these terms from time to time, for example when we add new services or payment options. When we do, we'll post the new version on this page and change the date at the top. Changes apply from that date forward.

Changes won't affect a camp, lesson or event Mike has already confirmed with you, unless you agree to them. They also don't change the terms for a dispute that started before the change.
